            <title>The influence of external procurement rules on national procurement system</title>

            <description><![CDATA[<p>Development partners and other donor countries resort to using their own procurement rules and reporting procedures when funding development projects which the recipient country must accept as part of the funding agreement. This practice, also adopted by bilateral donors and the multilateral development banks, has been attributed to the lack of confidence in the national procurement regulation in developing countries due to its ineffectiveness and corrupt practices as well as other accountability requirements of the donor.  As a result, procurement officers in developing countries are faced with juggling through multiple as well as parallel procurement systems, thus the use of national procurement system on one hand but also donor procurement rules on the other. This creates multiple implications for national capacity building and delays in executing procurement contracts with further implications for overall service delivery.</p>
<p>The research project intends to look at what influence(s) has the use of the external procurement systems on the regulation, administration and practice of national procurement rules, using Ghana as a case study. It will examine the influence of using parallel procurement systems on the application and practice of national procurement rules in Ghana. The research will also consider the practice and application of complaint procedures for national as well as external procurement rules, looking at which external regimes, including China and the World Bank are relevant.  With a socio-legal approach, the research will draw on legal and institutional resources. It will also seek to use interviews to develop the analysis and to employ the method of observation in gaining understanding of the practice of public procurement regulation.</p>

            <title>Research project regarding overriding requirements in the general interest</title>

            <description><![CDATA[<p>Dr. Andrea Sundstrand of the Faculty of Law at the University of Stockholm has been granted 3 years of funding for a research project regarding the concept of overriding requirements in the general interest in relation to the EU public procurement regulatory framework. The funding is provided by the Swedish Competition Authority (Konkurrensverket), which is the supervisional authority for public procurement in Sweden.</p>
<p>In the project, Dr. Andrea Sundstrand will examine the consept of overriding requirements in the general interest in relation to the possibilities to refrain from using the EU Procurement Directives due to different general interests, such as the protection of the environment, animal health i.e. The possibilities for national courts not to cancel a binding, unlawful, public contract due to an overriding requirement in the general interest will also be examined.</p>
<p>The result of the project will be published in a report in 2015.</p>

            <title>Ph.D. thesis on the principle of transparency and the choice of procedure</title>

            <description><![CDATA[<p><span class="module">The full title of the research project at Bucerius Law School in Hamburg, Germany, reads "The principle of transparency in the law of public procurement – Requirements for the choice of procedure".</span></p>
<p class="module">At the basis of the thesis will be an in-depth analysis of the principle of transparency in German and European procurement law and its possible dimensions in the procurement regime. The thesis will then assemble how the principle of transparency is expressed in the rules of procedure and determine the degree of transparency in each procedure. Subsequently, it will be examined whether the hierarchy of procedures in German procurement law and the prerequisites for their choice reflect a coherent level of transparency. The thesis will round up with building models for optimum and minimum transparency and hierarchy in and of procurement procedures, also in the light of current and constant reform on both the European and German level.</p>

            <title>How to construct a GPA-compliance domestic review system</title>

            <description><![CDATA[<p>Recently Dr. Xinglin Zhang obtained a funding from the Ministry of Education of P.R.China to conduct a research project on how to construct a GPA-compliance domestic review system. This research aims to help China, who is currently negotiating its GPA accession with other GPA parties, to develop a domestic review system that is compatible with the GPA rules on domestic review procedures. For this purpose, this research will first examine and analyze the GPA provisions on domestic review procedures and then look at how the major GPA parties (such as US, Japan, Hong Kong, China) bring their domestic review systems to comply with the GPA requirements on domestic review, and finally discuss how China reforms its current domestic review system, to comply with the GPA requirements on domestic review procedures.</p>

<p>Dr. Xinglin Zhang was a previous member of PPRG of Nottingham University Law School. She obtained her Ph.D degree in March 2009 and is currently an associate professor of law at the School of Law, Dongbei University of Finance and Economics (DUFE).</p>]]></description>

            <title>Public procurement of complex construction projects</title>

            <description><![CDATA[<p class="MsoNormal"><span lang="EN-GB"></span><span lang="EN-GB">My research project aims at identifying contractual mechanisms which reduce risk premiums and transactional costs in public procurement of complex construction contracts. </span></p>
<p>In order to identify contractual mechanisms which appears to reduce risk and transactional costs I conduct several case studies in which I apply law and economics theories to make an evaluation of risk and transaction costs in the procurement process and in the resulting contract.</p>
<p>Further, the intention is to investigate if the procedure competitive dialogue can be used in order to reduce asymmetric information between a procuring authority and bidders, in order to reduce transaction costs and risk premiums due to asymmetry.</p>
<p>The purpose is to identify public procurement and contract solutions which decrease costs associated with the procurement of construction projects.</p>

This topic will include a presentation of the general and special conditions of the public procurement contracts finance by European funds. It will also put in light their particularities issued from European law special provisions.<o:p></o:p></span></p>

            <title>Public Procurement Award Criteria in the EU Member States: A Comparative Case Study</title>

            <description><![CDATA[<p>My research project aims at comparing and contrasting the solutions provided by four national legal systems (Portugal, France, UK and Ireland) on the subject of public procurement award criteria.</p>
<p>My thesis will cover the following topics: the scope of the most economically advantageous tender; the linkage of the award criteria to the subject matter of the contract (permited v prohibited criteria); and the use of evaluation methodologies and their disclosure. Because I have the intention of investigating the topic not only from a strictly legal perspective, but also from a practical one, this involves doing empirical work (consisting mainly of research and analysis of contract notices, contract documents and award decisions).</p>
<p>The purposes of my research project are threefold:<br />(i) to show the variety of legal solutions and procurement practices regarding the same subject under a shared European framework; <br />(ii) to discuss the similarities and the differences considering, on the one hand, the apparent convergence brought about by the EC directives on public procurement and, on the other hand, the apparent divergence between the national implementation measures probably influenced by the legal family each system descends from; and <br />(iii) to allow the drawing of lessons learnt on the legislative, judiciary and administrative levels.</p>
<p>I am a current research student with the Public Procurement Research Group (PPRG) at the School of Law, University of Nottingham. I started my PhD in October 2009 under the joint supervision of Dr. Ping Wang and Professor David Fraser. I had secured a Law School scholarship for my research project, but later I was successful in obtaining funding from the Portuguese Governmental Research Funding Body (Fundação para a Ciência e Tecnologia).</p>

<p align="left">The Thesis focus on contracts whose value falls below the thresholds of the Public Procurement Directive, contracts that are listed in Annex II B of the Directive and contracts regarding service concessions.</p>
<p>The overall aim of the Thesis is to analyse which rules apply to contracting authorities when awarding a contract which is not covered or fully covered by the Public Procurement Directives.</p>
<p>The Thesis will furthermore look upon the enforcement rules and remedies regarding the above three types of contracts.</p>

            <title>Limitations to use of procedures involving negotiations</title>

            <description><![CDATA[<p>The Estonian law for public procurement states that below international thresholds the buyers are at liberty to use competitive dialogue (dir 2004/18 article 29) and negotiated procedure with prior publication of a contract notice (dir 2004/18 article 30) as they please. The buyer does not have to show that any of the preconditions referred to in the articles of the directive have been met.</p>
<p>The research analyses whether the general principles of transparency and equal treatment limit this liberty. It is also analysed whether the Leur-Bloem case law limits whether the legislator may permit using procedures of the directive without the preconditions arising out of the case law of the ECJ being present.</p>
<p>The absence of any analysis to explain the legislative choices is addressed.</p>]]></description>
