Dr. Andrea Sundstrand of the Faculty of Law at the University of Stockholm has been granted 3 years of funding for a research project regarding the concept of overriding requirements in the general interest in relation to the EU public procurement regulatory framework. The funding is provided by the Swedish Competition Authority (Konkurrensverket), which is the supervisional authority for public procurement in Sweden.
In the project, Dr. Andrea Sundstrand will examine the consept of overriding requirements in the general interest in relation to the possibilities to refrain from using the EU Procurement Directives due to different general interests, such as the protection of the environment, animal health i.e. The possibilities for national courts not to cancel a binding, unlawful, public contract due to an overriding requirement in the general interest will also be examined.
The result of the project will be published in a report in 2015.
